Limited Product Warranty
SEGGER Microcontroller GmbH (SEGGER) warrants its hardware products to be free from defects resulting from faulty manufacture or faulty components under the following terms. For SEGGER’s software products the warranty regulations in the respective license agreement apply.
WARRANTY PERIOD
SEGGER warrants that its hardware products shall be free from defects in materials and workmanship under normal use for a period of 1 (one) year from the date of shipment. The warranty period starts with the shipment of the hardware product (FCA Incoterms 2010).
COVERAGE
To the extent permitted by applicable law, this warranty does not apply to:
- Damage which results from accident, abuse, misuse, neglect, improper handling or improper installation
- Damage or loss of the product caused by undue physical or electrical stress, including but not limited to moisture, corrosive environments, high voltage surges, shipping, or abnormal working conditions
- Damage caused by operator error or non-compliance with instructions as set out in accompanying documentation or operating the product outside the permitted or intended uses described by SEGGER
- Products that have been serviced, altered, refurbished or modified by anyone who is not authorized by SEGGER
LIMITATIONS
SEGGER disclaims any express or implied warranties as to the noninfringement, merchantability, or fitness for a particular purpose of the hardware products.
SERVICE PROCEDURE
In the event that the hardware product proves defective during the warranty period, SEGGER will, at its own discretion, either repair or replace the hardware product with a new model. To obtain warranty service, the purchaser must have a return authorization from SEGGER and deliver the hardware product to the address specified by SEGGER. If it is not possible to remedy the defect, the purchaser is entitled to demand either withdrawal or reduction of the purchase price.
APPLICABLE LAW AND PLACE OF JURISDICTION
This Limited Product Warranty shall be governed by the laws of the Federal Republic of Germany, excluding its rules on conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods (CISG). Place of performance and exclusive place of jurisdiction for both parties is the registered office of SEGGER.
